The following terminology / definitions apply to these terms and conditions: Agent(s): means Opius Art Ltd of 76 Worple Road, Epsom, Surrey, KT18 7AF. Artist(s): means the seller of the artwork. Customer: means the buyer of the artwork. Buyer(s): means the buyer of the artwork. Visitor(s): means any person viewing the website located at opiusgallery.com for any reason. Artwork: means any goods offered or sold through opiusgallery.com. Goods: means any goods offered for sale on opiusgallery.com. Carrier: means any person or business contracted by the agent or artist to deliver the artwork to you the customer. Content: means information in any form published on our website opiusgallery.com by Opius Art Ltd or any third party with our consent. Website: means the website located at the domain opiusgallery.com.
By using our Website or purchasing our products or services you are accepting the terms and conditions set out in this document. Your statutory rights are not affected.
Placing Of Orders
The Customer may place an order for any of the Artwork advertised on our Website through the Website purchasing and payment system or over the phone. Payment is taken when the order is made followed by an order acknowledgement via email (this does not constitute our acceptance of the order)...
Due to the nature of original Artwork and limited edition prints your order is subject to a final check for availability. If the item is available you will receive an order confirmation via email which will constitute our acceptance of the order. If the item isn’t available you will be refunded in full.
By placing an order with us the Artist Agent through our Website purchasing and payment system or over the phone, you are making an offer to purchase Goods which if accepted by us will result in a binding contract.
Deliveries
The price quoted on our Website includes delivery within the UK for deliveries outside the UK you must contact us the Artist Agent for a quote. All payments must be paid in pounds sterling and in full before the Goods are dispatched.
The contact and delivery information provided by you the Customer will only be used by us the Artist Agent in our dealing with you and as necessary to other parties to make deliveries to you.
Most deliveries will need to be accepted and signed for. Orders of more than one item may be delivered separately.
Any delivery dates or times given are an estimate only and may vary. Deliveries outside the UK may take longer.
Refund Policy
You the Customer have the right to cancel an order for any reason, for a full refund within 14 days of receiving the Goods provided the Goods are returned within a further 14 days of the order cancellation at your own cost, in their original good condition and to the specific address stipulated by us the Artist Agent when you cancel the order.
A full refund of the purchase price will be given no later than another 14 days after the returned Artwork has been received.
Please note that commissioned Artwork cannot be returned.
Damaged Items
It is unlikely that items should turn up damaged but in the rare event that they do we would need to be informed immediately, we may also require you to take photographs of the damaged item for insurance purposes.
Copyright
Copyright and other relevant intellectual property rights exist on the full content of our Website.
Limits of Liability
The Customer / Visitor of our Website excludes all liability to us the Artist Agent for damages arising out of or in connection with your use of our Website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits were foreseeable, arose in the normal course of things or you have advised us the Artist Agent of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential, special and incidental damages or losses in any circumstances whether in contract, tort or otherwise. The Customer / Visitor further excludes all liability to us the Artist Agent against claims, demands and costs made by third parties against them arising out of their use of our Website.
The Artist Agent has no liability or responsibility whatsoever towards the Buyer in respect of the Artwork itself (this lays with the Artist). It is further agreed that the Artist Agent is not liable for any breach of our obligations resulting from causes beyond our reasonable control. The Buyer agrees that any claim is limited to the price paid for the artwork at the time of purchase.
A person who is not a party to this agreement shall have no rights under or in connection with it by virtue of the Contracts (Rights of Third Parties) Act 1999.
Product Information
We the Artist Agent do not check all the photographs or written descriptions accompanying Artwork offered for sale on our Website or any representations made by the Artist. Consequently we the Artist Agent cannot guarantee that such Content, are honest or truthful representations however if we become aware of errors in such descriptions or photographs we will ensure that either correction is made or the Content is removed. The Buyer purchasing Artwork buys with this knowledge and agrees that no liability can be attached to the Artist Agent for such content.
Applicable Law
This contract between us the Artist Agent and you the Customer / Visitor shall be governed and determined in accordance with English law. The courts of England shall have jurisdiction to hear and determine any action or proceedings to settle any disputes and determine any costs which may arise in connection with this agreement or any Goods or services provided.
Term Changes
We the Artist Agent reserve the right to change these terms and conditions from time to time as we see fit and the Customer / Visitor’s continued use of our Website or services will signify their acceptance of any adjustment to these terms and conditions.
